<p>The man decided to pursue an injury claim because the roof had only been made of an aluminium frame and there had been no warning signs; there was also the fact that he had not been given adequate working at height training by his employer.</p>
<p>The accident had caused the worker to smash the ball of his right shoulder in three places.  Despite having endured emergency surgery, he has been left permanently disabled with restricted movement in his arm.</p>
<p>While he was recovering from the accident, he had to sleep upright for a total of 16 months because of the constant pain.  He can no longer carry out every day tasks, such as opening cupboards at eye height.</p>
<p>The man was awarded personal injury compensation after Siemens admitted liability, however, Network Rail was also blamed for the incident.  At a joint settlement both firms settled the claim for over £164,000.</p>

<p>An investigation into the incident found that although there were light towers in the yard, only one set had been working; there was also the issue of the discarded rails, which should not have been left where they were.</p>
<p>The man was awarded £4,900 in personal injury compensation after his employer admitted liability and the claim was settled out of court.</p>

<p>The man decided to contact a personal injury solicitor after he suffered a painful back injury; he also found out that the trailer had actually been inspected and identified as faulty before the incident, yet was still sent out to be used.</p>
<p>The man suffered a soft tissue injury to his back and thumb and was unable to return to his job for over four months, which had a big impact on him financially as well as physically.  Thankfully he has nearly fully recovered, despite many back injuries often never healing completely.</p>
<p>His work injury claim was successful and he was awarded £8,500 in compensation after TDG Limited admitted liability; the case was settled out of court.</p>

<p>Mrs Bowler and another colleague had been trying to turn a patient onto her side, but hadn’t been provided with special ‘turn sheets’, which would have made the process much easier.</p>
<p>Also, the bed that they were trying to turn the heavy patient on was not the most ideal type, as it was a normal divan bed, not a profile bed which could have been raised in order to allow for lifting.</p>
<p>Due to the sheer weight of the patient, the carer ended up suffering from an extremely painful bulging disc.</p>
<p>Mrs Bowler decided to contact a personal injury solicitor because her injury meant that she could no longer continue with her line of work.<br />
She was forced to take four months off of work while she recovered from her injury &#8211; plus back pain, sciatica and numbness in her foot.</p>
<p>Although she did return to her job on light duties, she felt that her injury was preventing her from carrying out her job properly.  She now works as a classroom assistant and doctors have said that this accident has brought forward degenerative changes in her back by six years.</p>
<p>Mrs Bowler was awarded personal injury compensation after Southern Cross Health Care Group Plc, owner of Rowans Nursing Home, admitted liability.  It was argued that the specialist equipment should have been provided – the carer and other colleagues had asked for the ‘turn sheets’ before seeing the patient but the employer did not arrange for them to be there.</p>

The second operation was a success and has meant most of the pain has gone, however, she was unable to return to work for a long period of time as she recovered.  She eventually lost her job after working as a production operator for the past 12 years.</p>
<p>The injury also meant that Mrs Gray could not achieve once simple tasks, such as carrying out households chores and, most upsettingly, she couldn’t even lift her nine-month-old grandson.</p>
<p>Mrs Gray contacted a personal injury solicitor and an investigation revealed that there had been no risk assessments carried out by the company, which would have shown the need to automate this particular task. Newer machines had already been altered to avoid the need to lift the heavy part.</p>
<p>Tetley admitted liability after it was argued that the firm should have risk assessed the manual handling task.  Mrs Gray received a substantial amount of personal injury compensation and the claim was settled out of court.</p>

<p>An investigation carried out by the Health and Safety Executive (HSE), which is an organisation that often looks into work injury claims such as this one, found Mr Crow failed to check Mr</p>
<p>Brown was seated in the ride properly or was adequately restrained, leading to his colleague being thrown from the car once the ride had started.</p>
<p>The young man received personal injury compensation and Elliot Samuel Crow was found guilty of breaching Section 7(a) of the Health and Safety at Work etc Act 1974 and was fined £520. He was also ordered to pay £500 costs and a £15 Victim Surcharge, the proceeds of which will be spent on services for victims and witnesses.</p>

<p>The investigation into the claim found that the plywood that had been used to cover the manhole, was not suitable and should have been covered with something much stronger, such as a metal cover.  Or the area should have had a warning sign or barrier put in place to highlight the hazard.</p>
<p>The man received £5,500 in personal injury compensation after the company responsible for the site admitted liability.</p>

<p>The twenty-five-year-old man, who has not been named, was working for Worcestershire egg company, Bumble Hole Foods Ltd, when the accident took place.</p>
<p>As the young man was cleaning the drain situated on the production line, his right hand came into contact with a heavy duty blade.</p>
<p>The man sustained serious life-changing injuries, which is why he proceeded with his work injury claim.  He ended up losing part of his index and middle fingers on his right hand.</p>
<p>Redditch Magistrates&#8217; Court were told that the company was fully aware of the risks involved with such work, due to a similar incident that had happened two years previously</p>
<p>The Health and Safety Executive (HSE) investigation revealed that the training for this type of work was being carried out by employees who were not qualified to train others.</p>
<p>Bumble Hole Foods Ltd, of Fockbury, Bromsgrove, Worcestershire, pleaded guilty to breaching Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998.<br />
The company was fined £13,000 and ordered to pay costs of £6,303.<br />
Speaking after today&#8217;s hearing, HSE inspector Christopher Gregory said:<br />
&#8220;This incident was entirely foreseeable and easily preventable. The risks of cleaning around the drain had not been adequately assessed or controlled so unfortunately, a much larger price has been paid, not least by their employee.</p>

<p>Nottingham Crown Court heard that the tree ended up falling in an unexpected direction, causing the tractor to overturn and crush Mr Fox. He was killed instantly.</p>
<p>The investigation into the incident, which was carried out by the Health and Safety Executive (HSE), revealed that Mr Foljambe was responsible for failing to ensure both Mr Fox&#8217;s safety and that he had received adequate training in the equipment he was using.</p>
<p>Mr Foljambe of Mill Farm, Osberton, pleaded guilty to breaching Regulation 2(1) of the Health and Safety at Work etc Act 1974 and Regulation 9(1) of the Provision and Use of Work Equipment Regulations 1998.</p>
<p>He was fined £10,000 and ordered to pay costs of £20,327.</p>
<p>Speaking after the hearing, HSE inspector David Butter, said, &#8220;These employees had not been trained to carry out felling on this size of tree and were using inappropriate tools to assist them, which has unfortunately resulted in a death of a husband and father.&#8221;</p>
